1. General provisions
These Rules of Purchase and Sale (hereinafter referred to as the Rules) establish the mutual rights, obligations and responsibilities of the natural or legal person purchasing the goods in the e-shop www.alineko.com (hereinafter referred to as the Buyer) and MB Alinense (hereinafter referred to as the Seller). By placing an order, the Buyer confirms that he agrees with these Rules.
2. Purchase - conclusion of a sales contract
2.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased goods and formed a shopping cart and selected payment and delivery method, executes all order steps specified in the www.alineko.com e-shop, agrees to "Terms and Conditions", "Privacy Policy" and "Return Policy", clicks the "Pay" button. This Agreement is valid until the full fulfillment of the obligations of the Buyer and the Seller under these Rules.
2.2. Invoice at the request of the Buyer, sent by e-mail to the e-mail address specified during registration.
3. Buyer's rights
3.1. The Buyer has the right to purchase goods in the online store www.alineko.com in accordance with the Rules and the legal acts of the Republic of Lithuania in force at the time of purchase.
3.2. The Buyer has the right to withdraw from the contract of purchase and sale of goods concluded in the e-shop with the Seller by notifying the Seller in writing within 14 working days from the date of delivery of the goods. The Buyer has the right to withdraw from the contract of purchase and sale of goods with the Seller only if the goods are of good quality, have not been damaged, have not substantially changed in appearance, and if they has not been used.
4. Obligations of the Buyer
4.1. The Buyer must pay the price of the goods, as well as other payments (if such are specified when concluding the contract) and accept the ordered goods in accordance with the procedure established by these Rules.
4.2. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
4.3. By using the services of the online store www.alineko.com, the Buyer undertakes to comply with these Rules and other conditions established by the Seller and not to violate the applicable legal acts of the Republic of Lithuania.
5. Seller's Rights
5.1. If the Buyer tries to impair the operation or stable operation of the e-shop or violates its obligations, the Seller may, without prior notice, restrict, suspend the use of the e-shop and shall not be liable for any related losses of the Buyer.
5.2. In case of any doubts regarding the information provided in the order, the Seller shall contact the Buyer by phone or e-mail. In this case, the term of delivery of the goods starts from the day of contact with the Buyer. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Seller fails to contact the Buyer within 3 (three) business days.
5.3. The Seller has the right to unilaterally change these Rules. The amendments become effective for all post-publication transactions from the date of publication.
5.4. In special circumstances, the Seller may temporarily or permanently terminate the operation of the online store www.alineko.com without notifying the Buyer in advance.
6. Responsibilities of the Seller
6.1. The Seller undertakes to create conditions for the Buyer to properly use the services provided by the e-shop. The Seller does not provide any guarantee that the e-shop will operate continuously or that the data transmission will be error-free. The Seller will not be liable for any losses of the Buyer related to malfunctions of the e-shop and (or) data transmission errors.
6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
6.3. The Seller, in case of significant circumstances, unable to provide the Buyer with the ordered goods, undertakes the responsibility to offer an analogous product, and if the Buyer refuses to accept an analogue of the goods, return the money paid by the Buyer within 10 working days. In this case, the Seller is released from liability for non-delivery of the goods.
6.4. The Seller undertakes to respect the Buyer's privacy and the right to the protection of his personal information specified in the registration form of the online store www.alineko.com. This information may be disclosed only in accordance with the laws of the Republic of Lithuania. The Seller uses it in the cases specified in the "Personal Data Processing Rules" page.
7. Liability
7.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences of such actions.
7.2. The Buyer is responsible for the consequences of transferring Buyer"s login data to third parties. If the Seller's services are used by a person who has logged in to the online store www.alineko.com using the Buyer's data, the Seller considers this person to be the Buyer.
7.3. The Seller is released from any liability in cases where the Buyer incurs a loss due to failure to comply with these Rules, despite the Seller's recommendations and its obligations, even though he was given such an opportunity.
7.4. The Buyer is responsible for the actions performed using the online store www.alineko.com.
7.5. The parties shall be liable for the violation of the purchase and sale agreement concluded using the online store in accordance with the procedure established by the legal acts of the Republic of Lithuania.
7.6. It is forbidden to use and distribute the textual and graphic information on the online store www.alineko.com on other websites, websites, in the media and in other ways of public presentation of information without the written consent of MB "Alinense".
7.7. The Seller is not responsible for the discrepancy between the different features of the Buyer's computers and mobile devices, the colors and shapes of the goods in the e-shop and the actual colors and shapes of the goods.
8. Marketing measures applied by the seller
8.1. The Seller can initiate various promotions at the discretion of the online store www.alineko.com.
8.2. The Seller has the right to unilaterally, without separate notice, change the terms of the promotion and terminate them. Nevertheless, even after the termination of the shares, the obligations arising between the Seller and the Buyer during the purchase and sale of goods remain.
9. Processing of personal data
9.1. By clicking the "Buy" button, the Buyer confirms that he agrees to provide the Seller with his personal data and does not object to the Seller's processing of the personal data provided only for the Buyer's identification, formation of contracts, execution (online trade).
9.2. By clicking the "Buy" button, the Buyer confirms that he and his representatives know the right to refuse to provide their personal data, but understands that personal data is required and necessary to unambiguously identify the Buyer and / or his representatives when concluding contracts, execution ) and without the provision of personal data and / or consent to their processing for the above purposes will not be able to conclude and / or perform the contract.
10. Exchange of information
10.1. The Seller sends all notifications to the Buyer to the e-mail address provided in the Buyer's registration form.
10.2. The Buyer shall send all notices and questions to the Seller by e-mail to info@alineko.com
11. Final provisions
11.1. These rules have been drawn up in accordance with the applicable legal acts of the Republic of Lithuania.
11.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these Rules.
11.3. Any disagreement arising from the implementation of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
